Momentum Terms of Use

Introduction & Acceptance

  • Who we are. Momentum is run by Infinity Squared Media LLC (Mark Manson) (“we” or “Host”) on the Mighty Networks platform.
  • What rules apply. By joining, you agree to:
    1. these Momentum Terms,
    2. Mighty Networks’ Terms of Use,
    3. our Community Guidelines, and
    4. our Privacy Policy.
      If two rules conflict, the stricter one wins.
  • How you accept. Click “Join” or use the community after today’s date and you’re in. If you don’t agree, don’t sign up.
  • Updates. We may amend these Terms at any time without specific notice. It’s your responsibility to review the current version; staying in the community means you accept any changes.
  • Effective date. These Terms start May 1, 2025.

Eligibility & Registration

  • Age & capacity. You must be 18 + and able to sign a contract.
  • One account per person. Memberships are personal and can’t be shared or sold.
  • Keep your info true & current. Wrong or stale info can get you suspended.
  • Protect your login. You’re responsible for everything done through your account—tell us ASAP if it’s hacked.
  • Our right to say no. We may refuse or cancel any membership (e.g., past rule violations, unpaid fees).
  • Pay on time. Miss a payment and we may freeze or delete your account until the balance is cleared.
  • Follow local law. If you’re outside the U.S., make sure using Momentum is legal where you live.

Community Guidelines

By using Momentum you agree to follow both (a) the Momentum Community Rules (No Judgment, Radical Honesty, Vulnerability, Respect, Zero-Tolerance for Hate, Own Your Shit, Support Goes Both Ways, Listen First, Break the Trust → You’re Out, We’re All In This Together) and (b) all prohibitions in Mighty Networks’ Acceptable-Use Policy.

  • No harassment, hate, spam, or illegal activity.
  • No unsolicited self-promotion or selling.
  • Confidentiality is mandatory. What’s shared here stays here.
  • Enforcement. We may remove any post or terminate any account at any time, without notice or refund, if we believe you broke a rule or pose a risk to the community.

User-Generated Content

  • You own what you post. You keep all rights to text, images, audio, or video you upload (“Content”).
  • License to us & the Platform. You grant the Host a worldwide, royalty-free license to host, display, adapt, and share your Content inside Momentum, or in Host marketing only after (i) you give written permission or (ii) we anonymize it so you cannot be identified.
  • Your promises. You confirm your Content is original, lawful, and doesn’t violate anyone else’s rights or our Guidelines.
  • Our discretion. We may delete or edit any Content we feel breaches these Terms or the law—no notice required and no liability to you.

Membership Plans, Pricing, & Billing

  • We offer two membership options:
  • Monthly – $24.99 per month
  • Annual – $249.99 (two months free)
  • PLAN AUTO-RENEWS UNTIL CANCELED. Your chosen plan will keep charging the Payment Method on file at the stated interval unless you cancel. You can manage or cancel your subscription anytime—just open Profile → Account → Billing on the web, or tap Profile ➜ Account ➜ Billing in the mobile app, to update your payment method, change plans, or stop renewal. We also e-mail a purchase receipt after every charge and provide a direct “Cancel Subscription” link that you can use at any time. We will email you a reminder 3 days before your payment bills with a link to update your settings.
  • Payment processing. Payment is processed in U.S. dollars through the card you place on file (via Stripe), and you are responsible for any taxes or bank fees.
  • Refunds. We have a 60-day no questions asked satisfaction-guaranteed refund policy. Like any healthy relationship, this community is for people who want to be here. To request a refund, email support@findmomentum.com.
  • Cancelling. You may cancel at any time inside your account settings; the cancellation stops the next charge but does not prorate the current period.
  • Non-payment. If a charge fails, we may suspend or delete your account—and your access—until the outstanding balance is paid.
  • These terms keep the pricing simple, the rules clear, and your data protected.

Events, Courses, & Recordings

  • Schedule may change. Dates, times, topics, and presenters can shift or be cancelled. Membership fees are not refunded if that happens.
  • Sessions are recorded. Live calls, workshops, and Q&As may be video- or audio-recorded.
  • How we may use recordings. By attending, you consent to the recording. We may replay, excerpt, or repurpose the footage inside Momentum. If we wish to publish a clip of you outside the Platform, we will (a) get your written permission or (b) edit or anonymize it so you cannot be identified.
  • Replay window. Recordings are viewable only while your Subscription is active; sharing or downloading them is not allowed.

Intellectual-Property of Mark Manson

  • All videos, articles, PDFs, templates, trademarks, and other materials we provide are the copyrighted or trademarked property of Infinity Squared Media LLC.
  • Your licence. You receive a personal, revocable, non-exclusive, non-transferable licence to view those materials for your own use.
  • What you may not do. No copying, reposting, selling, translating, reverse-engineering, or creating derivative works without our prior written consent.
  • Permission requests. For press, educational, or commercial use, e-mail support@findmomentum.com before proceeding.

Privacy & Data Use

  • Privacy Policy governs. Our full data-handling practices live in the Mark Manson Privacy Policy. Mighty Networks also applies its own policy.
  • How we use your data. Registration details, usage stats, and payment info are used to (a) deliver the Services, (b) run analytics, and (c) send e-mails or in-app messages about Momentum. You can opt out of marketing e-mails, but not essential service notices.
  • Member list stays private. We never sell, rent, or trade the member directory. Third-party vendors (e.g., Stripe, email service, analytics) only process data to help us deliver the Services and must keep it confidential.
  • Public posts are public inside Momentum. Think before you share sensitive information; other Members may see it.
  • Anonymised quotes & stats. We may cite aggregated or anonymised data or quotes for marketing, research, and the development of new products and services, but never in a way that identifies you without permission.
  • Children’s privacy. Momentum is for adults 18+. We never knowingly collect personal data from children under 13; if we discover that we have, we delete it immediately.

Professional-Advice Disclaimers

  • Momentum offers educational and self-help information only.
  • It is not medical, mental-health, legal, tax, investment, or other professional advice.
  • Always consult a qualified professional about your specific situation.
  • If you feel unsafe or in crisis, call emergency services (e.g., 911 in the U.S. or 988 for the Suicide & Crisis Lifeline) or your local helpline.

DMCA / Copyright Takedown

  • We respect intellectual-property rights. If you believe material in Momentum infringes your copyright, send a written notice that meets 17 U.S.C. §512(c)(3) to:

  • Your notice must include: (1) identification of the copyrighted work, (2) the exact URL or location of the allegedly infringing material, (3) your contact info, (4) a statement of good-faith belief that use is unauthorized, (5) a statement under penalty of perjury that the information is accurate and you are the owner or authorized agent, and (6) your physical or electronic signature.
  • We will remove or disable the material and notify the poster, who may submit a counter-notice. Repeat infringers will lose their accounts.

Warranty Disclaimer

  • Momentum and all related content are provided “AS IS” and “AS AVAILABLE.”
  • We make no warranties—express, implied, or statutory—including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
  • We do not guarantee that the Services will be uninterrupted, secure, error-free, or that any defects will be corrected. Access may be suspended for maintenance, upgrades, or circumstances beyond our control.
  • You are responsible for backing up anything important. The Host is not liable for any loss of data, revenue, or other damages resulting from outages, errors, or reliance on the content.

Limitation of Liability

To the fullest extent allowed by law:

  • Cap on damages. Our total liability for any claim related to the Services is limited to the greater of (a) US $100 or (b) the total Subscription fees you paid during the 12 months before the event giving rise to the claim.
  • Excluded damages. We are not liable for any indirect, incidental, special, punitive, or consequential losses—including lost profits, lost data, or emotional distress—even if we knew such damages were possible.
  • Scope. These limits apply to any legal theory—contract, tort (including negligence), strict liability, or otherwise—and to the Host, its owners, employees, contractors, and affiliates. Some jurisdictions do not allow certain exclusions; where prohibited, the limitation applies to the maximum extent permitted.

Indemnification

  • You agree to defend, indemnify, and hold harmless the Host, its owners, employees, contractors, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) that arise from:
  1. the content you post or share;
  2. your breach of these Terms or any applicable law; or
  3. your misuse of the Community or the Services.
  • We may assume exclusive control of any matter subject to indemnification; if we do, you will cooperate with our defense.

Force Majeure

  • The Host is not liable for delays or failures to perform caused by events beyond our reasonable control, including but not limited to natural disasters, fire, flood, war, terrorism, civil unrest, government action, labor disputes, power or Internet outages, epidemics or pandemics, and outages or failures of the Mighty Networks platform or third-party providers.
  • If a Force Majeure event occurs, our obligations are suspended for its duration, and any deadlines are extended accordingly. Your payment obligations for amounts already due are not affected.

Termination & Suspension

  • Our right to act. We may suspend or terminate your membership, remove content, or block access immediately and without refund if we believe you
    • broke a rule or law,
    • failed to pay on time, or
    • pose legal or safety risk to the community.
  • Member cancellation. You may cancel whenever you like in account settings; your access continues until the end of the period you have already paid for and then stops. We do not prorate or refund unused time.
  • Effect of termination. All licences we granted to you end, and we may delete your content and account data at our discretion. We are not required to keep backups.
  • Service shutdown. We may discontinue Momentum entirely; if that happens, active members will receive a pro-rata refund for any prepaid, unused time.

Dispute Resolution & Governing Law

  • Governing law. These Terms are governed by the laws of the State of Texas, U.S.A., without regard to its conflict-of-laws rules.
  • Binding arbitration. Except for the small-claims and injunctive-relief carve-outs below, any controversy or claim arising out of or relating to these Terms or the Services will be settled by final, binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
  • Venue & language. The arbitration will take place in Travis County, Texas (or virtually, if the arbitrator so orders) before a single arbitrator and in English.
  • Individual proceedings only. You and we waive any right to a jury trial, class action, class arbitration, or any other representative proceeding.
  • Costs. Filing and arbitrator fees will be split 50/50 unless the arbitrator reallocates costs under the Rules or applicable law.
  • Opt-out. You may opt out of arbitration by emailing support@findmomentum.com within 30 days of first accepting these Terms. Opt-out is individual and cannot be transferred.
  • Small-claims & injunctive relief. Either party may:
  1. bring an individual action in a small-claims court located in Travis County, Texas, or
  2. seek temporary or permanent injunctive relief in any court of competent jurisdiction to protect intellectual-property or privacy rights.
  • One-year limitation. Any claim must be filed within one (1) year after it arose, or it is forever barred.

Changes to These Terms

  • We can update these Terms at any time. The revised version becomes effective the moment it is posted on this site.
  • Your continued use of the Services after a revision means you accept the new Terms—please check them periodically.
  • If we increase the base Subscription price, we will announce the new rate at least 30 days before your next renewal so you can decide whether to keep or cancel your membership.

Miscellaneous

  • Entire agreement. These Terms, the Community Guidelines, the Privacy Policy, and Mighty Networks’ policies are the whole deal between you and us; all prior conversations are superseded.
  • Severability. If any clause is unenforceable, the rest still applies.
  • No waiver. Our choice not to enforce a right now doesn’t waive it later.
  • Assignment. We may transfer our rights or obligations at any time; you may not transfer your membership without our written consent.
  • Electronic communications. You consent to receive notices and records electronically—by e-mail or inside the Platform.
  • Accessibility. We aim to make Momentum reasonably accessible to all users. If you need an accommodation to access any part of the Services, e-mail support@findmomentum.com and we will work with you to resolve the issue.
  • Headings. Section titles exist for convenience and have no legal effect.
  • Survival. Clauses on intellectual property, user-content licences, payment owed, disclaimers, limitation of liability, indemnification, dispute resolution, and any other terms that by their nature should survive termination will do so.
  • No partnership. Nothing here creates a joint venture, employment, or fiduciary relationship.
  • Third-party beneficiaries. Except for Mighty Networks and its affiliates, no one else has enforceable rights under these Terms.
